Multimedia Liability | $100,000 Limit Per Claim and in the Aggregate
Covers claims alleging liability resulting from the dissemination of online or offline media material, including copyright/trademark infringement, libel/slander, plagiarism, or personal injury.
Security & Privacy Liability | $100,000 Limit Per Claim and in the Aggregate
Covers claims alleging liability resulting from a security or privacy breach, including failure to safeguard personal information.
Privacy Regulatory Defense Penalties | $100,000 Limit Per Claim and in the Aggregate
Covers regulatory fines, penalties, and compensatory awards incurred in privacy regulatory proceedings or investigations brought by federal, state, or local governmental agencies.
PCI DSS Liability | $100,000 Limit Per Claim and in the Aggregate
Covers assessments, fines, or penalties imposed by banks or credit card companies due to non-compliance with the Payment Card Industry Data Security Standard (PCI DSS) or related payment card rules.
Breach Event Costs | $100,000 Limit Per Claim and in the Aggregate
Covers reasonable and necessary mitigation costs and expenses incurred as a result of a privacy breach, security breach, or adverse media report. Includes legal expenses, PR expenses, IT forensic costs, breach notifications, call centers, and credit monitoring or identity theft assistance.
The Breach Event Costs limit is in addition to, and does not reduce, the $100,000 Annual Aggregate Limit of Liability.
BrandGuard® | $100,000 Limit Per Claim and in the Aggregate
Covers net profit loss incurred as a direct result of an adverse media report or breach notification following a security or privacy breach. A 2-week waiting period applies.
System Failure | $100,000 Limit Per Claim and in the Aggregate
Covers reasonable and necessary amounts to recover or replace electronic data that is compromised, damaged, lost, erased, corrupted, or stolen. Also covers business income loss and interruption expenses from an unplanned outage or system failure, including hacking attacks. An 8-hour waiting period applies to Business Interruption coverage.
Cyber Extortion | $100,000 Limit Per Claim and in the Aggregate
Covers extortion expenses and ransom payments resulting from a credible cyber extortion threat, including ransomware.
Dependent Business Interruption | $100,000 Limit Per Claim and in the Aggregate
Covers income loss and interruption expenses if the computer system of an IT service provider or business process outsourcing provider experiences downtime. A 12-hour waiting period applies to Business Interruption coverage.
The coverages listed above are limited to $100,000 per claim and in the aggregate. The ERO Cyber Security Insurance policy has a maximum annual aggregate limit of $200,000.

If you need to report a suspected breach, contact the Tokio Marine HCC – Cyber & Professional Lines Claims team by emailing cpl.claims@tmhcc.com or calling 888-627-8995. Calls will be answered during or after business hours accordingly. You should also contact your insurance agent immediately.
If a cyberattack occurs outside regular business hours, you’ll be connected with a breach coach from Wilson Elser. Be sure to mention you are an AAA member.
Tokio Marine HCC’s claims department will work with Wilson Elser on the incident the next business day, request additional information, and contact you to ensure operations are restored quickly.

- Note: Print and store a hard copy of your member ID card to ensure access to key information during a data breach.
- Legal Counsel: The insurance company will assign legal counsel in the event of a covered claim or when deemed appropriate. If you retain your own counsel without insurer consent, you’ll be solely responsible for related legal fees and costs.
